These Terms and Conditions of Sale (Terms) govern every purchase made through the website opelmobile.com.au (Website) operated by 3 Feet Solutions Pty Ltd (ABN 29 621 087 278) trading as Opel Mobile (Opel Mobile, we, us or our). By placing an order, or by ticking the box confirming you have read and agree to these Terms at checkout, you (you or the customer) agree to be bound by them. Please read them carefully before completing your purchase, and keep a copy for your records.
Nothing in these Terms excludes, restricts or modifies, or purports to exclude, restrict or modify, any condition, warranty, guarantee, right or remedy implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (ACL) or any other law that cannot lawfully be excluded, restricted or modified. Where these Terms are inconsistent with such a law, the law prevails to the extent of the inconsistency.

- ACL means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- Consumer Guarantees means the guarantees that apply automatically to your purchase under the ACL and cannot be excluded, such as guarantees of acceptable quality, fitness for purpose, and matching description.
- Goods means any product listed for sale on the Website, including phones, tablets, home phones, wearables (including the SafetyPendant) and accessories.

2. Acceptance of these Terms
2.1 By ticking the checkbox at checkout stating that you have read and agree to these Terms, and/or by placing an Order, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.

3.1 We take reasonable care to ensure product descriptions, specifications and images on the Website are accurate, but colours, packaging and minor specifications may vary from images shown, and we do not warrant that all details are error-free

4. Orders, Order Acceptance and Payment
4.1 Placing an Order through the Website is an offer by you to purchase the Goods on these Receiving an automated order confirmation email does not mean your Order has been accepted — it confirms only that we have received your Order.
4.2 A binding contract is formed between you and us only when we confirm that your Order has been accepted for dispatch (for example, by sending you a shipping or dispatch confirmation).
4.3 We may decline or cancel an Order (in whole or part) before dispatch, including where a Good is unavailable, where we reasonably suspect fraud or an unauthorised transaction, or where there is a pricing or listing error under clause 3. Where we cancel an Order after payment has been taken, we will refund the affected amount in full within a reasonable time.
4.4 We accept payment by the methods shown at checkout. Full payment is generally required at the time of You warrant that any payment information you provide is accurate and that you are authorised to use the chosen payment method.
5. Delivery, Shipping and Risk
5.1 Delivery timeframes and shipping costs shown on the Website or at checkout are estimates only, based on information from our couriers and warehouses, and are not guaranteed delivery dates. We are not liable for delays caused by circumstances outside our reasonable control, including courier delays, weather, or events beyond our control.
5.2 Risk in the Goods (including risk of loss or damage) passes to you on delivery to the address you Ownership of the Goods passes to you once we have received payment in full.
5.3 You are responsible for ensuring the delivery address and contact details you provide are correct. We are not responsible for failed delivery caused by incorrect or incomplete address details you have provided.
5.4 If Goods are lost or damaged in transit, please contact us as soon as possible using the details in clause 15 so we can assist — this does not affect your rights under the Consumer Guarantees.
6. Returns, Refunds and Exchanges
Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
6.1 Faulty, damaged or not-as-described Goods (your Consumer Guarantee rights)
If Goods you purchase are faulty, not of acceptable quality, not fit for the purpose disclosed, significantly different from their description, or otherwise fail to meet a Consumer Guarantee, you are entitled to a remedy under the ACL. Depending on whether the problem is a major or minor failure, you may be entitled to choose a refund or replacement, or we may choose to repair the Goods within a reasonable time. To make a claim, contact us using the details in clause 15 with your proof of purchase and a description of the fault. We will assess your claim and respond within a reasonable time. This right exists independently of, and in addition to, any warranty described in clause 7.
6.2 Change of mind
The ACL does not require us to provide a refund or exchange if you simply change your mind. As a matter of customer service, we allow change-of-mind returns on the following conditions:
- the Goods must be unopened and returned in their original, undamaged packaging;
- you must contact us to request a return within 14 days of the date of purchase;
- you must obtain a Return Authority Number from us before sending the Goods back — returned Goods will not be accepted unless accompanied by a Return Authority Number;
- return shipping is at your own expense; and
- we will refund the cost of the returned item(s) The cost of the original shipment is not refunded. This change-of-mind policy is offered voluntarily and does not limit or replace your rights under clause 6.1.
6.3 How to start a return
Contact our customer service team before returning any Goods, so we can issue a Return Authority Number and provide the correct return shipping address. Returned Goods will not be accepted unless accompanied by a Return Authority Number. Please do not send Goods back without first contacting us.

7. Warranty
- In addition to your rights under the Consumer Guarantees, eligible Goods purchased from the Website come with a voluntary warranty against defects from Opel Mobile for the period stated on the relevant product page or packaging (typically 12 months from the date of purchase) (Warranty Period).
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits given to you by this warranty are in addition to other rights and remedies available to you under the Australian Consumer Law.
7.2 What we will do
If Goods develop a defect covered by this warranty during the Warranty Period, we will, at our discretion, repair or replace the Goods (or a faulty component), or provide a refund, within a reasonable time.
7.3 How to make a warranty claim
To make a warranty claim, contact us at the details in clause 15 with your proof of purchase, a description of the fault, and (where requested) images or video of the issue. We may ask you to return the Goods to us at the address we provide; unless the Goods are found not to be faulty, we will cover the reasonable cost of returning them to us for a valid warranty claim.
7.4 What this warranty does not cover
This voluntary warranty does not cover damage or faults caused by, or arising from:
- accidental damage, liquid/moisture damage, or physical damage (e.g. cracked screens, drops);
- normal wear and tear, including battery capacity decline over time;
- misuse, neglect, unauthorized modification, or use contrary to the product’s user guide;
- repair or attempted repair by anyone other than us or a repairer we authorize;
- connection to an incompatible power supply, accessory, network or SIM; or

8. Cancellation
- You may request to cancel an Order at any time before it has been dispatched by contacting us using the details in clause 15. Once Goods have been dispatched, clause 6 (Returns) applies instead.
- We may cancel an Order before dispatch in the circumstances described in clause 3, in which case we will refund any amount you have paid for that Order in full.
9. Important Information About Safety Features and Emergency Calling
Some Opel Mobile Goods include features intended to support personal safety and independence, such as an SOS button, emergency call or SMS functions, location sharing, or (for the SafetyPendant) a fall-alert function (together, Safety Features). Please read this clause carefully, as it explains the limits of these features.
- Not a substitute for emergency services or professional care. Safety Features are an aid only. They are not a substitute for calling emergency services (Triple Zero / 000) where possible, and are not a substitute for professional medical care, supervision or monitoring.
- Dependent on network coverage and other factors. SOS calls, emergency calls, SMS alerts and location features rely on adequate mobile network coverage, a charged and powered-on device, a valid and active SIM/service, correct setup, and the receiving contact being reachable. Coverage gaps, network outages, low battery, incorrect setup or an inactive SIM can prevent Safety Features from working as expected.
- No guarantee of detection or response Where a Good includes fall-detection or similar functionality, we do not guarantee that every fall or medical event will be detected, or that any alert will be sent or received within a particular time. We recommend testing Safety Features regularly and keeping emergency contact details up to date.
- Not a medical Unless expressly stated on the relevant product page, Opel Mobile Goods are not medical devices and are not intended to diagnose, monitor, treat or prevent any medical condition. If you have concerns about your health or the health of the person using the device, please consult a medical professional.
Nothing in this clause 9 excludes, restricts or modifies your rights under the Consumer Guarantees, including your right to Goods that are of acceptable quality and fit for the purpose disclosed to us.
10. Privacy
- We collect, use, store and disclose personal information in accordance with our Privacy Policy, available at opelmobile.com.au/privacy-policy, which forms part of these Our Privacy Policy explains what personal information we collect when you use the Website or place an Order, how we use and protect it, and how you can access or correct it.
- We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Where a product involves the collection of location or health-adjacent information (for example, through the SafetyPendant), we treat that information with the additional care required by applicable privacy law.
11. Intellectual Property
- All content on the Website, including text, graphics, logos, product images and the Opel Mobile name and branding, is owned by or licensed to 3 Feet Solutions Pty Ltd and is protected by copyright, trade mark and other intellectual property
- You may view and download content from the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify or commercially exploit any content from the Website without our prior written
12. Limitation of Liability
- To the maximum extent permitted by law, and subject to clause 12.3, our total liability to you arising out of or in connection with these Terms or your purchase of Goods, whether in contract, tort (including negligence), under statute or otherwise, is limited, at our option, to: (a) the replacement of the Goods or the supply of equivalent goods; (b) the repair of the Goods; or (c) the payment of the cost of replacing the Goods or of acquiring equivalent goods.
- To the maximum extent permitted by law, we are not liable for any indirect, special or consequential loss, or loss of profits, arising out of or in connection with these Terms or your purchase, except where such loss is a direct result of our failure to comply with a Consumer Guarantee.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against any loss, damage, cost or expense we reasonably incur arising from your breach of these Terms, your misuse of the Goods, or your provision of incorrect information in connection with your Order, except to the extent that the loss, damage, cost or expense was caused or contributed to by us.
14. Governing Law and Dispute Resolution
- These Terms are governed by the laws of New South Wales, You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
- If you have a complaint or dispute, please contact our customer service team first using the details in clause 15 so we can try to resolve it If we are unable to resolve your complaint, you may contact your state or territory fair trading or consumer affairs body, or the Australian Competition and Consumer Commission (ACCC), for further assistance.

16. Amendment of These Terms
- We may update these Terms from time to time, including to reflect changes in law, our practices, or the Goods we offer. The Terms that applied to your Order are the version in force and accepted by you at the time you placed that Order; any changes will apply only to Orders placed after the updated Terms are published on the Website.
